BD&J Law Firm Explains New California Driving Laws
With California’s ongoing issue of drunk and reckless driving, which leads to thousands of crashes annually, new traffic safety legislation has been implemented starting January 1, 2026. This legislative change aims to enhance road safety by penalizing drivers who do not follow safe driving practices. Three key bills that have been adopted in the state are AB 366, AB 1087, and SB 720. These laws focus on addressing various aspects of unsafe driving behavior, from DUI offenses to red light violations.
AB 366 Extends Nationwide Pilot Program

AB 366 extends a nationwide pilot program that requires ignition interlock devices (IDDs) in vehicles operated by previously convicted DUI offenders until January 1st, 2033. These devices mandate a breathalyzer test before the vehicle can start, ensuring that the driver is not under the influence of alcohol. This measure is designed to prevent intoxicated individuals from operating a vehicle, thereby reducing the risk of accidents caused by impaired driving.
AB 1087 Increases Probation Time for Vehicular Manslaughter
AB 1087 increases the probation period for drivers convicted of vehicular manslaughter or gross vehicular manslaughter from an initial 2 years to 3-5 years. According to BD&J Partner Lauren Horwitz, “Alcohol-related roadway deaths have increased by 50% in the last decade. These laws are working to stop and reverse that trend.”
SB 720 Authorizes Automated Traffic Enforcement Systems

To further reduce crashes, especially those involving pedestrians and cyclists at intersections, SB 720 authorizes the installation of automated traffic enforcement systems in areas where drivers are required to stop. These systems will record any traffic violations at these locations. Cities such as Los Angeles, Glendale, Oakland, San Jose, and the City and County of San Francisco are among the first to implement these systems.
